The aim of this testimony is to alert people who are going to make such an important purchase as a land/house to possible frauds and dishonest behaviors.
We contacted Immosky for a land to buy in the Ollon/Villars (VD, CH) area in which we would have built a house. After some information, we were asked to sign a reservation contract, providing some money in advance. First problem was that this contract was not detailed at all: for example, not even the surface of the land was mentioned (indeed the land had not yet been separated from the larger area it was originally connected…). After some exchanges, we finally obtained to have more information about the land in the contract, including a drawing, established by a surveyor that was said to be already approved by the municipality.
After so much effort we decided to sign the reservation contract and provide in advance the money (******** CHF) asked for.
Few days after we became aware of the law LAT by which the municipality and Canton must redefine (reduce) the overall buildable area. The municipality transferred me immediately a letter (already sent to the land owner weeks ahead) in which it was stated that the land was not yet confirmed to be buildable or not, it would take at least some months to define it.
For this reason, I contacted Immosky proposing to establish a new contract of reservation whose validity would depend upon the land to be buildable or not, motivating this request by the fact that the contract was not valid (land not yet buildable).
Answer from Immosky was: The contract is still valid because:
• Land was buildable (not true, according to the municipality)
• Immosky was not obliged to tell us about this law that has such an impact on the land
After several exchanges in which it was clear they were not willing to accept their fault of giving us wrong information, once they said they had received a new letter from the municipality confirming that land to be buildable.
I called the municipality for clarifications and they said such a letter didn’t exists! At that point I was disgusted by such a behavior of Immosky and I wrote them, with the municipality in copy, telling them that:
• They have no ethical rules (they were not obliged to tell us about the law LAT? Come on, what are they paid for!);
• Since they were trying, without accepting the evidences above-mentioned, to make us buying a land (overall price 260.000 CHF) of which the buildability was everything but assured, I said they were dishonest;
• Since it was clear they just wanted to make money, doesn’t matter how, I defined them thieves.
Immediately Immosky contacted me saying once again that the land was buildable (again…) and even proposing me an architect of them to build our “perfect house”.
I replied that, not knowing yet the buildability of the land, we didn’t want to involve more money in the project (money for the architect, the notary, etc…) and that we were asking the money of the reservation back (as they always refuse to establish a new contract and I didn’t ask for it anymore) and please to give us an answer since a lawyer was waiting for our ok to proceed.
As they realized they could get no more money from us, a message arrived saying that because of our threats (asking help to a lawyer is a threat? ...) and insults (all justified by evidences) if I would have denounced them they would have open a criminal procedure against me (is this not a threat against me!?).
For this reason, no denounce was made and they kept 5400 CHF as a compensation for the good job they did and nice and relaxing services they provided us.
Not enough the land was again in several internet announces!
